RESOLUTION No. 2014-8
RESOLUTION REGARDING OFF-ROAD UTILITY (ORV) AND ALL-TERRAIN VEHICLE (ATV) OPERATION IN DICKINSON COUNTY, IOWA
WHEREAS Dickinson County has considered the growing popularity and use of Off-Road Utility Vehicles (ORV) and All-Terrain Vehicles (ATV), AND
WHEREAS Dickinson County acknowledges that the operation of such vehicles is regulated by Iowa Code Section 321, specifically Sections 321.20B and 321.234A, which statutes allow counties to designate county roads upon which such vehicles may be operated, AND
WHEREAS the Dickinson County Board of Supervisors, in consultation with the Dickinson County Engineer and Dickinson County Sheriff, has evaluated traffic conditions on all County highways and roadways, determining that off-road utility vehicles and all-terrain vehicles can be safely operated on all such roadways, with the exception of Level C roadways, without interfering with or causing an undue hazard to conventional motor vehicle traffic.
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS: That registered and properly insured and licensed all-terrain vehicles and off-road utility vehicles may be operated by licensed drivers on Dickinson County roadways (with the exception of Level C roads) from the date of adoption of this Resolution.
